Collection of Information

Personally Identifiable Information: We collect certain information you voluntarily provide to us, such as when you send us an email or sign up to receive email or message updates, fill out a form, submit Content in accordance with the Terms of Service for Content, or connect through a social feed. At different occasions you may be asked for certain types of personally identifiable information (e.g., your first and last name, city, state, zip code, telephone number, email address, written testimonial etc.). If you do not want to disclose your personally identifiable information to us, please do not submit it. This does mean that in some cases we will not be able to provide you the service you have requested.

Technical Information: We may record certain non-identifiable information that becomes available to us as a result of your visit to our website, including, without limitation, the number and frequency of visitors to our website. This information includes, for example, the websites that you access immediately before and after your visit to our website, the Internet browser you are using, and your IP address. If we use such data at all, it will be on an aggregate basis, and we will not disclose to third parties any information that could be used to identify you personally.

We may use cookies to recognize you when you return to the Site in order to provide you with a better user experience. We may allow third parties to use cookies on the Site but we do not control the use or contents of third party cookies. Web browsers often allow you to erase existing cookies from your browser cache, block the use of cookies and/or be notified when cookies are encountered. If you elect to block cookies, please note that you may not be able to take full advantage of the features and functions of the Site.

Herbalife uses third party analytics tools to understand how visitors use this Site. These analytics tools use cookies to generate information on your use of this Site (including your IP address), which is then transmitted to and stored by our third party service providers on servers in the United States. This information is used to evaluate the visitor statistics to improve content, navigation and structure. We or our third parties may also transfer this information to other third parties as required by law or where such third parties process the information on our or our service provider’s behalf. Our service providers will not associate IP addresses with other data collected from other sources. You may refuse the use of cookies by selecting the appropriate settings on your browser.

Do Not Track Requests. Because an industry-standard DNT protocol is not yet established, Herbalife’s information collection and disclosure practices and the choices it offers to consumers will continue to operate as described in this Privacy Policy regardless of the “do not track” choice made by the consumer. However, Herbalife and the third-party vendors who operate on our behalf only track your browsing history for the reasons described in the Collection of Information section of this Privacy Policy, and we do not allow third parties to engage in online behavioral advertising on our websites. Herbalife does not collect personally identifiable information about an individual’s online activities over time or across third-party websites or online services.

Children. This Site is a general audience web site that is not specifically designed or targeted at children. We do not knowingly collect, use or disseminate any personally identifiable information from children under the age of 13. If, however, we become aware that personally identifiable information regarding a child under the age of 13 has been collected at the Site, we will delete such information.

We use the information that is collected about you for a variety of purposes. At the time we collect your information you will be given the choice to accept or refuse the disclosure of your information for such marketing purposes, and for marketing by Herbalife. You may also submit written testimonials for display on the Site in accordance with the Terms of Service for Content.

However, we will not share your information with unaffiliated third parties for marketing purposes.

Herbalife may also share your personal information to fulfill its legal obligations in response to a request from the government or private parties in connection with a lawsuit, subpoena, investigation or similar proceeding, or to respond to a matter of personal or public safety, to investigate security incidents, to protect our interests, rights and property, or in the event of a sale or transfer of assets, or in the context of similar business negotiations. Herbalife may also share Content submissions with regulatory authorities as may be required or requested under applicable law. You hereby authorize Herbalife to disclose any such information in those circumstances.
